ElectIQ is an electronic voting software platform operated by Mannes Technology Consulting, S.L., a company registered in Barcelona, Spain.

These Terms govern access to and use of the ElectIQ platform and related services.

By accessing or using ElectIQ, you agree to these Terms.

If you use ElectIQ on behalf of an organization, you express that you are authorized to represent that organization.

ElectIQ may be provided under three modalities:

Modality 1 - Managed Voting (Cloud – Contact Data Processed)

We host and operate the platform and may process voter contact data strictly on behalf of the client organization. A separate Data Processing Agreement (DPA) applies.

Modality 2 - Anonymous Link Distribution

We provide anonymized voting infrastructure without processing voter personal data.

Modality 3 - On-Premises Installation

The software is deployed on the client’s infrastructure. The client assumes full responsibility for system operation and data management.

ElectIQ services are intended for organizations, institutions, associations, and similar entities. Individual consumer use is not supported unless expressly agreed.

Users must:

• - Provide accurate registration information
• - Maintain confidentiality of credentials
• - Use the service lawfully

Clients may use ElectIQ solely to conduct lawful voting processes.

You agree not to:

• - Use the platform for unlawful, fraudulent, or deceptive activities
• - Attempt to reverse engineer, disrupt, or compromise system security
• - Interfere with elections conducted by other clients

Where ElectIQ processes personal data on behalf of a client, processing is governed by:

• - General Data Protection Regulation (GDPR)
• - Ley Orgánica 3/2018 (LOPDGDD)

ElectIQ implements state-of-the-art technical and organizational measures, including:

• - End-to-end encryption of voting processes
• - Encryption at rest
• - EU-based hosting
• - Multi-factor authentication (where applicable)
• - Audit logging to preserve election integrity

We strive to ensure high availability and reliability. However:

• - Temporary interruptions may occur for maintenance or security reasons
• - We do not guarantee uninterrupted or error-free operation
• - On-premise deployments are maintained by the client

All intellectual property rights in the ElectIQ software, platform, and related materials remain the exclusive property of Mannes Technology Consulting, S.L.

Clients receive a limited, non-exclusive, non-transferable license to use the software during the term of the agreement.

No ownership rights are transferred.

Both parties agree to maintain the confidentiality of non-public technical, organizational, and commercial information exchanged in connection with the service.

This obligation persists after service termination.

To the maximum extent permitted by law:

• - ElectIQ shall not be liable for indirect, incidental, or consequential damages.
• - Liability arising from use of the service shall be limited to the fees paid by the client in the 12 months preceding the claim.

We may suspend or terminate access if:

• - The client materially breaches these Terms.
• - The platform is used unlawfully.
• - Due to requirement by law or regulatory authority.

These Terms are governed by the laws of Spain.

Any disputes shall be submitted to the courts of Barcelona, Spain.

We may update these Terms to reflect legal or operational changes.

The latest version will always be available on our website. Continued use of the service constitutes acceptance of the updated Terms.
